June 19, 2024 – Notice of Proposed Regulation Amendments & Public Hearing
MDEQ is providing notice of proposed revisions to the Mississippi air regulations in 11 Miss. Admin. Code Part 2, Chapters 6 – “Air Emissions Operating Permit Regulations for the Purposes of Title V of the Federal Clean Air Act.” The public hearing is scheduled for June 19, 2024 at 10AM.
The proposed amendments incorporate recent Federal rule makings for consistency with our state regulations plus miscellaneous changes for clarity and consistency. The proposed changes include the following:
- Revisions to Public Participation Provisions. For each permit subject to notice under the New Source Review (NSR) or Title V permit programs, these revisions remove the mandatory requirement to provide public notice of a draft permit through publication in a newspaper and, instead, allow for electronic notice of permitting actions sufficiently via the MDEQ website.
- Revisions to the Title V Petition Process. New language will broaden the entities MDEQ must transmit copies of petitions, responses, and other information to, and require how copies are saved.
- Defining Key Terms Pertaining to “Oil and Natural Gas Sources” in SIC major group 13. This will clarify the term “adjacent” when used in determining the Title V status of a facility.
- Removal of the Title V Emergency Affirmative Defense Provisions.
- Miscellaneous Changes to Nomenclature and Formatting to Add Clarity and Consistency
